"55 & Older Subdivision"

In Early December a letter from a long-time resident was sent to the POA Board and their attorney. In the letter, the resident indicated the Boards proposal to sell off part of the Shoreline Golf Course to create a new “55 and older” subdivision. That property is surrounded by enumerated lots protectedagainst anything except single family residential development by the Declaration of Restrictions. The proposed 55 and older separate community would have it’s own amenities including it’s new gated
entrance off Broad Creek Road.
The POA Board on its own purchased 2 lots (#119 and #120 Jamaica section 5 to use for the entrance). Each lot cost the POA $36,000. These lots have covenants running with the land. In the Declarations it states all enumerated lots within the subdivision are for single family Residential purposes only. The letter went on to say they did not think the POA Board has the authority to Change the Covenants to use the lots as entrances. The lots should be sold for market value and the money returned to the POA
general fund.
The POA Board ownership of those lots do not give them special powers. The declaration is clear ALL owners must abide by those declarations. There is even a provision that states you cannot enter the subdivision from any point but the designated roads within the Subdivision.

What's going on here is wrong and is pushing the community in the wrong direction !
