Dear Fairfield Harbour Property Owners,
After two failed votes, five Board members have unilaterally decided to impose a $10 million Club House project on our community—an expense that also includes interest and contingencies. This building (the Clubhouse) will not be located on common property. This means the Board at any time in the future could potentially sell it without community consent.
In a troubling move to safeguard their positions, these 5 Board members have amended our bylaws to make it significantly more difficult to remove them. They now require 2/3's approval instead of the original 1/2. While it's still possible to remove Board members, the process has become much harder. This overreach has put our finances—and potentially our homes—at risk.
At a recent contentious meeting, the Board revealed that they have pledged our dues as collateral for a $6.5 million loan. This despite overwhelming opposition from residents who clearly stated "Let Us all Vote on it."
In another recent revelation, the Board admitted they have increased our dues by $322 to cover the anticipated loan for the Club House, a project they misleadingly described as "FULLY FUNDED." This decision, made without a community vote for approval, has significant implications for our finances and our community’s future.
It is now imperative to remove the four remaining Board members who voted for this costly project. The remaining appointed member will be spared for the time being.
Here’s why it’s crucial to act now:
> We need change to Regain Control: We, the property owners, must take full control of the Board to implement necessary changes and prevent future missteps. We need a policy overhaul to stop the construction and ensure that all major decisions are subjected to a community vote.
> We need change to Ensure Transparency: The Board has withheld records, contracts, and has continued to hold closed-door meetings, preventing us from fully understanding their decisions.
The four Board members subject to removal might be your friends, neighbors, or acquaintances. Regardless of personal connections, their names are listed on the petition in accordance with legal requirements. We appreciate your understanding and support as we move forward with this process. It is unacceptable for a small group of individuals to impose millions of dollars in debt on our community. The membership can stop this. You need to be involved with your signature on the petitions and vote. If the POA Board can’t afford a community vote, then it would appear FFH can’t afford a $10 million Club House. They have also maxed out our credit at the bank.
A dictatorship has a few autocrats that make decisions for us. A real community works together as one. So, let’s bring this community together to make a 'change in direction' permanent. Together, we can take measures to ensure that our POA Board can never attempt this again! To that end, we are currently setting up stations to collect signed petitions. One to remove 4 directors under NC statute 55A-7-02. And another for Judicial Removal of the 4 board members as per 55A-8-10.

Despite the POA Board’s attempts to obstruct us by changing the rules aimed at preventing us from using signs to direct you, FHstop is committed to making this process accessible.
